(“Autocares Julià”), as joint controllers (together, “ADB”) with respect to the users (“Users”) who visit the website (the “Website” or the “Site”). Both value your trust as a User and your privacy, and for this reason explain below how your data is processed. Unless otherwise indicated in this Privacy Policy, all capitalized terms used herein have the meanings given to them in the General Conditions applicable to the purchase of Tickets.
- WHO IS THE CONTROLLER OF YOUR DATA?
The joint controllers of personal data for the sale of Tickets through the Website are AUTOCARS NADAL, S.A., with Tax ID 914074-F and registered office at Avda. Tarragona, 44-46. AD500 (Andorra la Vella) Principality of Andorra, and AUTOCARES JULIÀ S.L., with Tax ID B08095390 and registered office: C/ Pablo Iglesias, 84 08908 L’Hospitalet de Llobregat (Barcelona) Spain. Pursuant to their joint responsibility agreement and the distribution of obligations stipulated therein, Autocars Nadal will manage your data when the purchase is made from Andorra and Autocares Julià when the purchase is made from Spain.
You can contact ADB’s Privacy Officer as established in section 10 of this Privacy Policy. - WHAT DATA IS PROCESSED BY ADB?
A personal data (“Data”) is any information about an identified or identifiable natural person (the “Data Subject”). The Data processed by ADB comes from the information you provide as a User when filling in the forms found on the Website, when browsing the Website, when purchasing Tickets through the Website, and/or when sending your inquiries or requests for information.
In each form, ADB indicates the contact Data that is mandatory to process your request by means of an asterisk. Fields not marked as mandatory with an asterisk are completely optional. Only the Data necessary for each purpose is collected. Please note that if you do not provide the mandatory information, ADB may not be able to process your request or manage the processing.
It is your responsibility to provide truthful Data and keep it updated; therefore, ADB reserves the right to exclude from the services and/or cancel them Users who provide false, incorrect or unauthorized Data, without prejudice to ADB’s right to take any legal action that may correspond. - FOR WHAT PURPOSE DOES ADB PROCESS YOUR DATA?
ADB will process your Data for the following purposes:
A. REGISTRATION ON THE WEBSITE. When you register on the Website and create an account (the “Account”), ADB may use your Data to manage the registration and your Account, as well as to comply with the applicable legal obligations. ADB may process your Data to contact you and to provide you with offers and additional information about ADB, if you have consented.
B. PURCHASE AND/OR MANAGEMENT OF TICKETS. When you purchase a Ticket through any channel made available, ADB will process your Data to manage the purchase, the consultation of Tickets, possible changes and/or cancellations, and to send you related notifications, as well as to comply with the applicable legal obligations. It will also process your Data to contact you regarding the purchase and to send you communications that may be of interest to you.
C. SUBSCRIPTION TO THE NEWSLETTER. If you wish to receive news of interest about ADB, its programs or promotional offers, ADB will process your contact Data to manage the sending of such communications to the email address provided through the form.
D. CONTACT AND/OR CUSTOMER SERVICE. If you contact ADB through the channels enabled for this purpose, by email or any means made available, ADB will process the contact Data and details you provide in order to properly address your queries or requests. It may also process your Data to send you communications that may be of interest to you, if you have consented.
E. BROWSING THE WEBSITE. Through the use of cookies and other technologies, ADB may carry out measurements and analyze browsing traffic, usability and your experience as a User on the Website in a statistical way. The installation and use of cookies depends on the configuration you make both in the cookie banner and through your browser. - WHAT IS THE LEGAL BASIS FOR PROCESSING YOUR DATA?
ADB may carry out the processing for the purposes described above on the following legal bases:
The legal basis for processing your Data for registration on the Website and the purchase and/or management of Tickets is the performance of the contract and compliance with legal obligations. Please note that, if you are a Ticket purchaser, ADB may also send you communications based on its legitimate interest, and offer you offers and news that may be of interest to you. You may also receive commercial communications from entities of the Julià Group if you have consented.
The legal basis for processing your Data for contacting ADB, sending commercial communications and/or when subscribing to the newsletter is the consent you have provided through the registration in the corresponding forms and/or the cookie banner. In some cases, the processing of your Data when contacting ADB may be based on the performance of pre-contractual measures if these are necessary to handle the query.
For the processing of your Data in relation to browsing the Website, the legal basis is the consent you give when accepting the installation of cookies, which you may revoke or configure at any time through the settings panel. Please remember that you may revoke your consent at any time. You may also object to receiving further commercial communications in the manner indicated in the footer of each communication. - HOW LONG WILL YOUR DATA BE KEPT?
Your Data will be kept for the period necessary for the purpose for which it was collected, and specifically:
a. Regarding registration on the Website and management of the Account, ADB will retain your Data for as long as necessary until you delete your profile from the Website and thereafter it will remain blocked for the retention periods or limitation periods legally established.
b. Regarding the purchase of Tickets and their management, your Data will be retained for as long as necessary to manage it and thereafter will remain blocked for the retention periods or limitation periods legally established.
c. Regarding the sending of communications, your Data will be processed until you revoke your consent, object to the processing and/or request the deletion of your Data, up to a maximum of two years.
d. Regarding the Data you provide to ADB for queries or to contact us, it will be processed for as long as necessary to respond to your query or request, as well as, where appropriate, for the time necessary to handle possible claims or queries from you.
e. Regarding browsing Data, until you revoke your consent and for a maximum period of 14 months. In any case, traffic information is periodically deleted, so ADB will retain only anonymized usage statistics (without User identification).
Once the Data is no longer necessary for the purpose for which it was processed, it will remain blocked solely for the purpose of addressing any liability or obligations that may arise from its processing. - TO WHOM WILL YOUR DATA BE DISCLOSED?
Your Data may be disclosed to service providers who help ADB carry out its activities, such as IT tools, technical support services, payment providers, marketing tools, etc. Likewise, the Data may be transferred to group entities for commercial purposes, if you have consented.
Some of the providers mentioned may have processing and/or support centers located outside the European Economic Area (EEA). ADB guarantees that, when your Data may leave the EEA, they will maintain the same level of protection based on compliance with the provisions of the European data protection regulations. Where necessary to comply with ADB’s legal obligations, Data may be communicated to the public administration and the State Security Forces and Bodies. - REGISTRATION AND MONITORING OF CORPORATE SOCIAL MEDIA ACCOUNTS
For the profiles that ADB maintains on the different social networks linked from this Website, for example, through plugins or third-party applications, your Data may be processed under other privacy policies of the owners of said social networks.
The use of such connectors is voluntary. If you choose to use them, you will be authorizing the communication of your personal Data (IP address, browsing data) to said social networks and ADB will not be responsible for the subsequent processing that they may carry out with your Data. ADB is particularly concerned about ensuring the security of your personal Data. Likewise, if you have any doubts regarding the exercise of your rights, before contacting the supervisory authority, you may, if you wish, consult ADB directly by writing to ADB’s Privacy Officer, who will try to help you in the best possible way.
Finally, ADB reminds you that you have the right to file a complaint with the competent data protection authority (in Spain, www.aepd.es and in Andorra, www.apda.ad) if you become aware of or consider that a fact may constitute a breach of the applicable data protection regulations.
